The Role

Dunn Law is a Miami business and insolvency firm. One of our partners serves as a Chapter 7 panel bankruptcy trustee in the Southern District of Florida, and the firm represents creditors, committees, assignees, and receivers in bankruptcy cases, assignments for the benefit of creditors under Chapter 727, Florida Statutes, and the litigation that grows out of them.

The Senior Bankruptcy Attorney leads the firm’s Chapter 7 trustee representation work, taking each case from the initial asset review through recovery, litigation, and the final report.

This is a senior associate or junior partner level position. The attorney runs a caseload without day to day oversight, directs the associates and paralegals assigned to it, and reports results to the Managing Partner.

Essential Functions

Duties and responsibilities

Trustee representation

  • Evaluate new Chapter 7 cases for administrable assets and estate claims, and recommend whether and how to pursue them.
  • Serve as lead counsel to the trustee on asset sales under Section 363, compromises under Rule 9019, turnover, and objections to exemptions and discharge.
  • Direct the investigation after the Section 341 meeting, including document demands and Rule 2004 examinations.

Estate litigation

  • Lead turnover, preference, and fraudulent transfer litigation under Sections 542, 547, 548, and 544(b), from demand through trial.
  • Sit first chair at evidentiary hearings and trials in the United States Bankruptcy Court for the Southern District of Florida.
  • Control the Section 546 limitations period across the firm’s trustee portfolio.

Case management and supervision

  • Set strategy and staffing on each assigned matter and see it through to resolution.
  • Supervise associates and paralegals on assigned matters, review their work product, and develop their judgment.

Reporting, calendar and time

  • Report case status, recoveries, and open risks to the Managing Partner at the weekly case review.
  • Maintain the deadline calendar for the trustee portfolio, confirming each date against the entered order.
  • Record time contemporaneously by the end of each business day, and prepare fee applications for court approval.

Fiduciary and creditor matters

  • Advise on Chapter 727 assignments for the benefit of creditors and state court receiverships filed through the Florida E-Filing Portal.
  • Represent creditors, committees, and purchasers of distressed assets in Chapter 7 and Chapter 11 cases.

Practice development

  • Maintain working relationships with panel trustees, the Office of the United States Trustee, and the insolvency bar.
  • Write and speak on bankruptcy and insolvency topics on behalf of the firm.

Qualifications

Required and preferred qualifications

Required

  • Member in good standing of The Florida Bar and admitted to the United States District Court for the Southern District of Florida.
  • Seven or more years of bankruptcy practice.
  • Substantial experience representing Chapter 7 trustees, or a comparable fiduciary practice.
  • Experience as first chair at evidentiary hearings or trial.
  • A record of managing matters independently from engagement through resolution.
  • Experience supervising associates and paralegals.
  • Proficiency with CM/ECF, PACER, and the Florida E-Filing Portal.

Preferred

  • Chapter 11 experience, including trustee, examiner, or committee representation.
  • Experience with Chapter 727 assignments or state court receiverships.
  • Board certification in Business Bankruptcy Law by The Florida Bar or the American Board of Certification.
  • Active involvement in the Bankruptcy Bar Association of the Southern District of Florida.
  • An established referral network in the insolvency community.
  • Working Spanish, spoken and written.
Professional Standards

Supervision and scope

The Senior Bankruptcy Attorney exercises independent professional judgment on assigned matters and reports to the Managing Partner. As a supervising lawyer, the attorney is responsible for the conduct of the associates and staff working on those matters.

Estate work carries fiduciary duties owed to creditors and to the court. Accuracy in a sale motion, a settlement, or a final report is a legal obligation and is treated as one.

Supervisory responsibilities within the firm follow Rules 4-5.1 and 4-5.3 of the Rules Regulating The Florida Bar.

Work environment

Professional office. Extended periods at a workstation using a computer and telephone, sustained review of detailed documents, and regular local travel to courthouses, depositions, and mediations. Hours extend as hearings, trial settings, and filing deadlines require.
