The Role

Dunn Law is a Miami business and insolvency firm. One of our partners serves as a Chapter 7 panel bankruptcy trustee in the Southern District of Florida, and the firm represents creditors, committees, assignees, and receivers in bankruptcy cases, assignments for the benefit of creditors under Chapter 727, Florida Statutes, and the litigation that grows out of them.

The Associate Attorney carries a docket of bankruptcy and creditors’ rights matters: representing the Chapter 7 trustee in estate administration and litigation, representing creditors in bankruptcy cases, and prosecuting collection and judgment enforcement actions in Florida state court.

Associates work directly with partners and are expected to bring a researched recommendation rather than an open question, and to deliver drafts that need editing rather than rewriting.

Essential Functions

Duties and responsibilities

Chapter 7 trustee representation

  • Prepare applications to employ, motions to sell estate property under Section 363, motions to approve compromises under Rule 9019, and objections to exemptions and discharge.
  • Review debtor production after the Section 341 meeting and conduct Rule 2004 examinations.
  • Evaluate schedules and financial records for unscheduled assets and estate causes of action, and recommend a course of action to the supervising partner.

Avoidance actions and adversary proceedings

  • Draft demand letters and complaints for preference and fraudulent transfer claims under Sections 547, 548, and 544(b), and track the Section 546 limitations period on every assigned estate.
  • Manage written discovery, take and defend depositions, and brief and argue dispositive motions.
  • Negotiate settlements within the authority given and prepare the motions that approve them.

Creditor representation in bankruptcy

  • Represent secured and unsecured creditors in Chapter 7, 11, and 13 cases: proofs of claim, stay relief, cash collateral, and plan objections.
  • Prosecute nondischargeability complaints under Section 523 and objections to discharge under Section 727 of the Bankruptcy Code.
  • Monitor bar dates, objection deadlines, and confirmation schedules across an active portfolio.

Collections and judgment enforcement

  • Prosecute commercial collection actions in Florida circuit and county courts through the Florida E-Filing Portal, from complaint through default or summary judgment.
  • Enforce judgments through post-judgment discovery, garnishment, and proceedings supplementary under Section 56.29, Florida Statutes.

Assignments and receiverships

  • Support the firm’s Chapter 727 assignments for the benefit of creditors and state court receiverships, including claim review and objections, asset sales, and reports to the court.
  • Track the claims filing deadline and the reporting schedule in each assignment and receivership, and prepare the related filings through the Florida E-Filing Portal.

Court appearances, calendar and time

  • Appear at hearings in the United States Bankruptcy Court for the Southern District of Florida and in Florida state courts, in person and by video.
  • Maintain the deadline calendar for assigned matters, confirming each date against the entered order, and report status at the weekly case review.
  • Record time contemporaneously by the end of each business day, with descriptions sufficient to support a fee application reviewed by the court.

Qualifications

Required and preferred qualifications

Required

  • Member in good standing of The Florida Bar.
  • Two or more years of practice in bankruptcy, creditors’ rights, or commercial litigation.
  • Working knowledge of the Bankruptcy Code and the Federal Rules of Bankruptcy Procedure, including Chapter 7 practice.
  • Admission to the United States District Court for the Southern District of Florida, or eligibility to obtain it promptly.
  • Experience drafting motions and arguing them at hearings.
  • Experience taking and defending depositions.
  • Proficiency with CM/ECF, PACER, and the Florida E-Filing Portal.
  • Strong legal research and writing, shown in a writing sample.

Preferred

  • Experience representing Chapter 7 trustees, receivers, or assignees.
  • Preference and fraudulent transfer litigation.
  • Florida judgment enforcement, including garnishment and proceedings supplementary.
  • Chapter 11 experience, including plan and confirmation work.
  • Familiarity with Southern District of Florida local rules and chambers procedures.
  • Working Spanish, spoken and written.
Professional Standards

Supervision and scope

The Associate Attorney practices under the supervision of a partner, who sets strategy on each matter and reviews significant filings before they are made. The associate is responsible for the accuracy of every filing and every representation made to a court.

Estate work carries fiduciary duties owed to creditors and to the court. Accuracy in a claim objection, a sale motion, or a settlement is a legal obligation and is treated as one.

Supervisory responsibilities within the firm follow Rules 4-5.1 and 4-5.2 of the Rules Regulating The Florida Bar.

Work environment

Professional office. Extended periods at a workstation using a computer and telephone, sustained review of detailed documents, and regular local travel to courthouses, depositions, and mediations. Hours extend as hearings, trial settings, and filing deadlines require.
