Amrit S. Kapai is a partner at Dunn Law, P.A. whose practice focuses on bankruptcy, insolvency, receiverships, and complex commercial litigation. He regularly represents Chapter 7 trustees, court-appointed receivers and other fiduciaries, creditors, secured lenders, landlords, and debtors in bankruptcy cases, contested matters, adversary proceedings, and related state and federal litigation.

Amrit has substantial experience investigating and pursuing claims on behalf of bankruptcy estates and fiduciaries, including fraudulent transfer and preference actions, breach of fiduciary duty claims, professional liability matters, and other litigation involving the recovery of assets for creditors. His practice also includes contested asset sales, disputes concerning secured claims and collateral, relief from stay proceedings, claims and priority disputes, enforcement of guaranties, and the negotiation and court approval of complex settlements. He frequently advises trustees and receivers concerning the investigation, preservation, liquidation, and distribution of assets, including real estate, operating businesses, vehicles, equipment, litigation claims, and other estate property.

On the creditor side, Amrit has represented banks, equipment lessors, finance companies, landlords, and other commercial parties in bankruptcy and non-bankruptcy disputes involving breach of contract, guarantor liability, replevin, secured transactions, and enforcement of creditor remedies. Earlier in his career, he spent several years at a global law firm representing a multinational banking institution in financial services litigation arising under federal and state banking laws.

Amrit has extensive courtroom and litigation experience in both federal and state courts. He also regularly uses negotiated resolutions, workouts, and other alternative dispute resolution tools to maximize recoveries and resolve complex disputes efficiently.

Before joining Dunn Law, Amrit was a partner at Goldstein & McClintock LLLP and a litigation attorney at Mayer Brown LLP in Chicago. He also interned for bankruptcy judges in the United States Bankruptcy Courts for the Southern District of Florida and the Eastern District of Missouri.

  • Represented numerous secured lenders in corporate restructuring matters by pursuing relief from the automatic stay, seeking adequate protection payments, and negotiating 363 asset sales
  • Prepared a victorious appellate brief in the Illinois Second District Appellate Court involving breach of guaranty claims on behalf of an equipment lessor
